The Tenth Circuit Court of Appeals has overturned a district court injunction in a class action, that had granted the Class of 2022 an automatic fifth year of eligibility. The case is still active but for now, the injunction has been lifted. The appeals court action does not impact other state court cases and decisions. However, since this was the only class action involving the new five-in-five rules impact on the Class of 2022, more athletes were impacted. The five-in-five rule granted an automatic fifth year of eligibility to all members in a Division I program in the class of 2023 and beyond. It did away with the old system of waivers to grant all athletes five years of eligibility, from their first full year of competition or age 19, whichever came first. Current athletes could still choose to use the old set of rules.
